TERMS OF USE

You Can Do It! Education (YCDI!) is the trading name for The Bernard Group PTY LTD (TBG).

These Terms of Use apply to you when you subscribe or purchase from YCDI! through youcandoiteducation.com.au, or an offline purchase or booking of any goods and services with YCDI! Education via telephone or email.

If you make any purchase on behalf of a school or organisation, you agree to the Terms of Use in the name of the school or organisation.

All content (including lesson content, online guides and downloadable worksheets from any YCDI! Education programs can only be used with a current paid subscription license. 

Schools, educational organisations or individuals cannot use lessons, guides, or worksheets previously printed or downloaded for teaching purposes beyond the end of the subscription date.

Schools, educational organisations or individuals cannot share any YCDI! subscription content with anyone outside the school or educational organisation.

All school or educational organisation staff must be aware of these terms to avoid any misuse of the YCDI! Education intellectual property.

As a result of school closures due to COVID-19 schools that purchased annual licences for the YCDI! curricula programs will be allowed to continue the teaching by educators of YCDI! through distance learning.  Schools may distribute the programs’ content electronically (e.g., Student Worksheet, modified Lesson plans). Under no circumstances can any school staff member share the school login to parents or other individuals to access the curricula programs.

Schools may modify or abridge the lessons to suit their students’ needs during this period.  The Bernard Group (TBG) cannot accept any responsibility for the accuracy or efficacy of any altered or abridged materials sent home by schools.

Any YCDI! content, in any form, may only be shared with families in your school community.  The intellectual property of all YCDI! programs and resources, including any modifications made by schools of existing lessons for use at home by parents, remains with The Bernard Group. Schools are required to notify their parents of this when providing any YCDI! materials to their school community.

Annual licences purchased by schools are for use only by educators within the school.  Sharing the school login with parents or other individuals outside the school is not permitted.

This website is hosted in Australia. When using this website from outside Australia, by providing your information to this site, you consent to transfer your information to Australia for processing and maintenance in accordance with the Privacy Policy, Terms of Use, Security Policy and Disclaimer herein. You are also consenting to the application of Australian law in all matters concerning this site.

This website’s items for sale consist of digital content, non-digital content, services. These items are also referred to as programs, resources, goods, courses, elearning and training. The cost of the items for sale is identified clearly in this website’s online SHOP.

Processing of purchases of any goods and services is through an accredited commerce plugin.

All purchases carried out are final and non-refundable unless the goods and services cannot be accessed or delivered.

All goods and services purchased within Australia attract the Australian Federal Government Goods and Services Tax (GST) of 10%. Purchases outside of Australia are exempt from GST. The total GST paid is shown in the Tax Invoice.

All monetary values shown on this website and invoices use Australian Dollars.

All online YCDI! digital programs access is for a one-year digital subscription (365 days) from the date of enrolment. Access to purchased online digital programs is for the period of the subscription.

Schools, Educational Organisations and Mental Health Practitioners

When purchasing YCDI! online digital curricula or other online digital programs you and your school or educational organisation is committing to an annual digital subscription (365 days) from the date of enrolment.

Schools or educational organisations with more than one campus need to purchase a separate digital subscription individually per program that each campus will be using.  YCDI! digital resources accessed through a school’s or educational organisation’s LOGIN are not transferable between campuses.  Each campus is required to have a unique LOGIN. 

YCDI! Elearning training courses purchased provide each participant with an individual LOGIN.  Participants must not share their LOGIN details with other individuals.  Elearning course participation is accessible for 90 days from the date of enrolment.  Schools/Educational Organisations/Individuals cannot extend participants 90 days access period. Individuals wanting additional time will need to purchase a new course enrolment.

Individuals

Purchases by parents or other individuals do not enter a subscription agreement. Access to the online YCDI! digital program will expire 365 days following purchase. Parents and individuals cannot purchase any online digital program listed in the Education Resources Catalogue. The programs are for personal use only.

Except for the ‘preview‘ resources, online digital resources require unique log in access.  A purchased LOGIN is required to access any online YCDI! resources. Users must ensure that the username and password are kept confidential and not shared with anyone beyond the school or educational organisation without written authority from The Bernard Group.

LOGIN Access

A school or educational organisation’s LOGIN will not become inaccessible unless the school or educational organisation chooses to cancel the subscription.  The Bernard Group does not suspend access to a LOGIN even if a school or educational organisation has not paid the digital license renewal on time. LOGINs are only closed when a school or educational organisation notifies their intention to cancel the digital license or does not pay the outstanding renewal invoice within 60 days.

Individual LOGINs become inaccessible at the end of the online digital licence period: 90 days for elearning training courses or 365 days for online digital programs.

Schools, educational organisations or individuals cannot share any LOGIN details or YCDI! subscription content with anyone.

All staff must be aware of these terms to avoid any misuse of the YCDI! Education intellectual property.

Cancellation of digital subscriptions must be submitted in writing and emailed to YCDI! Education at enquiries@youcandoiteducation.com.au. Cancellations occur at the end of the current paid 365 days digital subscription period.

Australian Copyright Law covers this website and its contents.  The Bernard Group owns, has licensed or has permission for all intellectual property used throughout this website.  Individuals seeking reproduction requests or rights enquiries should email enquiries@thebernardgroup.com.au.

Australian Copyright Law also covers all online YCDI! digital and non-digital content. 

Reproducing, copying or printing of any digital pr non-digital materials listed for purchase in the YCDI! catalogue (programs, posters, student handbooks) is not permitted.

Content (printed material, downloadable files, all online digital and non-digital resources) may not be shared or communicated with individuals outside your school.  Access and use of online digital programs are not permitted beyond the annual digital licensing period.  Please read our full terms of use.

Schools or educational organisations wanting to use YCDI! visuals, logos or other YCDI! materials outside of our terms of use must send a request in writing to enquiries@youcandoiteducation.com.au

The Bernard Group takes the protection of its copyright very seriously. If The Bernard Group discovers that you have used its copyright materials in contravention of the above terms, The Bernard Group may bring legal proceedings against you seeking monetary damages and an injunction to stop you using those materials. You could also be ordered to pay legal costs. If you become aware of any use of The Bernard Group’s copyright materials that contravenes or may contravene the license above, please report this by email to enquiries@thebernardgroup.com.au

The Bernard Group commits to keeping any details you provide private.  As the supplier of your purchases of goods and services available on the website, we use this information to identify you and communicate with you regarding your purchases. We do not pass on, sell or swap any of your details with anyone else.

The Bernard Group will take reasonable technical and organisational precautions to prevent the loss, misuse or alteration of your personal information.

All transactions with The Bernard Group are processed in Australian dollars ($AUD) unless otherwise stated.

All information is provided by The Bernard Group in good faith, including this website, digital and non-digital items. To our knowledge, the information provided is accurate and current. The Bernard Group does not accept any responsibility for the accuracy or completeness of any information or material on this site or in any digital or hard copy document.

Education, our users, or others.

Please choose your purchases carefully. We do not usually give refunds if you simply change your mind or select the wrong product. You can choose between a refund, exchange or credit where products were incorrectly described or different from the product described on the website or don’t perform as advertised.

Event participation cancellations less than 48 hours notice before the workshop date will not be refunded.

A participant incurs a $50 admin fee for all other events or workshop cancellations.

YCDI! can provide only the dietary options specified in the registration form at the time of registration.

The Bernard Group does not host credit card data during or after processing. Credit card details are transmitted through a secure server when purchasing from The Bernard Group.  All information exchanged between your computer or device and The Bernard Group is via a secure, encrypted protocol {HTTPS, independently certificated and with TLS encryption (TLS replaces the now deprecated SSL encryption)}.
